Dr. Benishek: “Please Obey The Constitution, Mr. President”

Jan 5, 2012 Issues: Congressional Issues

WASHINGTON, DC:  Congressman Dan Benishek (MI-01) today released the following statement:

“President Obama’s decision to circumvent the U.S. Constitution by making recess appointments without the consent of the Senate and without Congress being adjourned is a disturbing exercise of executive power.

I believe the American people deserve better than an Administration that ignores a century of executive precedent to appoint a new director at the Consumer Financial Protection Bureau (CFPB) and three individuals to the National Labor Relations Board (NRLB).  Last summer, the House passed legislation (H.R. 1315) that would establish a five-member, bipartisan commission to manage the CFPB, rather than another Washington ‘czar.’

The President’s unprecedented course of action threatens the system of checks and balances put in place by the framers of our government.  In response, many of my colleagues in the House and I, sent a letter to President Obama that expresses the House’s deep objections to the Administration’s decision to make these appointments and our fear this action will permanently endanger the confirmation process.

Instead of dodging the Constitution to appoint more federal bureaucrats to interfere in the private sector, I believe the Administration should focus on working with Congress to do the people’s business and grow the economy.”
